For several months last year, the National Institute of Housing and Urbanism, the Ministry of Housing and Human Settlements and other related public institutions, together with the private sector, carried out the task of comprehensively reforming the Regulations to the Law Regulating Condominium Property (Executive Decree No. 45214-MIVAH-MEIC-TUR, which was published on October 22, 2025).
This task responds to the need to standardize certain criteria and to organize various partial reforms that have been carried out in recent years.
As a result of this project being a comprehensive reform, the regulation granted a transitional period for its entry into force and this deadline expired on January 19, hence this new regulation is already in force.
In general terms, the changes to the regulations provide clarification on certain issues, through the inclusion of additional definitions or clearer definitions and establish greater uniformity in terms of the requirements for the approval of the plans by the applicable institutions. In addition, it regulates issues that have become current needs, such as electric vehicle charging and electronic surveillance systems.
In accordance with the above, as of January 19, any property owner who wishes to submit a property to the condominium property regime must comply with the provisions of this new regulation and, in the same way, it applies to modifications of existing condominiums, as well as the extinction of this regime.
It is important to mention that this regulation has many technical issues, so it is important that not only legal professionals know it, but also professionals in engineering and areas related to real estate development.
Currently, several bills are in the pipeline to implement partial reforms to the Condominium Property Law, some of them being quite ambitious in terms of adjusting said legislation to the current needs of the country and to the lessons learned regarding the application of current legislation.
