New rules in the Costa Rican public sector administrative procedures

On September 1st, 2022, Executive Decree No. 43665-MP-MEIC was published in the official newspaper La Gaceta, through which the exchange of information between public institutions in Costa Rica was approved, accelerating the procedures of those administered in said institutions and promoting the Principle of Interinstitutional Coordination.

This decree reinforces the Law for the Protection of Citizens from Excess Requirements and Administrative Procedures and its respective regulations.

This decree obliges the entire Central Administration (the State, the Executive Branch and attached bodies, such as but not limited to public ministries), as well as the Decentralized Administration (for example, state banks, ICT, PANI, public universities, ICE, INS, CNFL, ESPH) to review in the public databases of the Public Administration any requirements or document required for an administrative procedure, eliminating the obligation of the administrative to provide said documents.

Any certification, record or information that appears in the public databases (for example, legal status of companies, powers registered in the National Registry, permits, license, proof of being up to date with the CCSS, Treasury), must be reviewed by the Administration without the administrator having to contribute it to the public entity.

The only exception to these regulations applies when the information contained in the public database is protected by the Law for the Protection of Persons against the Processing of their Personal Data and the Law on Narcotic Drugs, Psychotropic Substances, Drugs for Unauthorized Use, Related Activities, Money Laundering and Financing of Terrorism, or else, are protected by another law of the Republic of Costa Rica (where there is no inter-institutional coordination).

This decree is applicable from its publication, starting September 1st, 2022.
