Our counselors are responsible
for the litigation of a variety of cases, both public and
private, filed in judicial, administrative and arbitration
courts. The Firm represents clients in civil, commercial,
tax, and criminal matters, as well as in lawsuits
pertaining to administrative contracts and international
commerce. Nevertheless, the main goal is
to always minimize the risk of litigation. The Firm's
attorneys are familiar with and efficiently apply the latest
trends in negotiation, mediation, arbitration and other mechanisms
for alternative dispute resolution, and maintain close links
with the main organizations offering these services on a global
level, such as ICSID and AAA.
Regarding private lawsuits,
the firm specializes in the following areas: property and
leasing torts, breach of contracts, sales disputes, all actions
derived form mercantile acts, products and professional liability,
securities, intellectual property and trademarks, and all
other types of commercial litigation.
The Firm also specializes
in Administrative Claims and Public
Law Suits. Under Costa Rican Law, similarly to most
Continental legal systems in Europe, a previous “Administrative
process” is required before lawsuits can be formalized
in any dispute in which the State or any of its agencies or
public enterprises is part. Our Firm has ample experience
handling claims through these administrative remedies, as
well as the ensuing judicial proceedings. The litigation practice
covers a wide range of administrative and judicial proceedings
at all levels.
Also, we have a very ample
experience in litigation in connection with distribution agreements.
In this specific commercial area, it is important to mention
that in Costa Rica there is a law named Sales Representative
Act of Costa Rica which was enacted to protect the Costa Rican
representatives, distributors and/or manufacturers of foreign
companies engaged in business in the country.
